By using songcart.io or the SongCart desktop application (collectively, the "Service"), you agree to the terms below. If you don't agree, please don't use the Service.

Pre-release status

SongCart is currently pre-release. The desktop application is being built and not yet generally available. Features described on this website may change before launch. Joining the signup list does not guarantee access on any specific date or pricing.

The signup list

Submitting your email through the signup form authorizes SongCart to send you product updates by email until you unsubscribe. We will not send more than a few emails per quarter, and every email includes a one-click unsubscribe.

Your music, your responsibility

SongCart is a local music player. It plays audio files that already exist on your computer. It does not stream copyrighted music, and it does not provide tools to circumvent DRM, rip from streaming services, or otherwise acquire music in violation of applicable copyright law. You are responsible for ensuring that the music files you play through SongCart were obtained lawfully (purchased downloads, your own recordings, public- domain works, properly licensed files, etc.).

No warranty

The Service is provided "as is" without warranty of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Pre-release software in particular may contain bugs or change behavior between versions.

Limitation of liability

To the maximum extent permitted by law, SongCart and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any direct damages will not exceed the amount you have paid us in the twelve months preceding the claim (which, during pre-release, is zero).

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. (TODO: confirm the actual jurisdiction once the operating entity is finalized.)

Changes

We may revise these terms from time to time. Substantial changes will be announced on the homepage and to the signup list before they take effect.
